Lemon Law Attorney | Serving Clients in Los Angeles & throughout California
Like any other transaction, when you purchase a car, you are being promised a working product. Your car should start, run, and be driveable. However, there are car sellers out there that take advantage of customers by selling ‘lemons.’
California defines a lemon as a defective vehicle that cannot be repaired after a “reasonable number of attempts.” The California Lemon Law protects consumers that are sold lemons. It requires the manufacturer to replace or repurchase the vehicle. If you believe you were sold a “lemon” and you are having issues returning it, contact a California consumer lawyer from our firm today.
What Cars Are Covered Under the Lemon Law?
Almost all new and used vehicles purchased or leased in California are covered by the Lemon Law, as long as they are still under a manufacturer’s new car warranty. Additionally, the law covers vehicles for eighteen months after the purchase or lease or cars with less than 18,000 miles on them.
The “reasonable number of attempts” is not numerically defined, but there are some guidelines. If the manufacturer or dealership has tried at least twice to repair a problem that could cause injury or death if left unrepaired, the Lemon Law can apply. Cars that the manufacturer or dealership has tried to fix the same problem on at least four times are also covered.
Vehicles that have been in the shop for repairs for more than thirty days, leaving the owner unable to drive them for that amount of time, can be covered by the Lemon Law. The thirty days do not have to be consecutive. The law can apply if multiple visits add up to thirty days.
